Terms & Conditions

Definitions
This Web Site, www.clocktowerelectrics.co.uk is operated by Visitsafe Ltd t/as Clocktower Electrics (referred to as "we", "our" or "us"). These terms will apply to all your (referred to as "you" or "your") purchases of items from this Website, whether you are ordering online or by telephone. Please read this document carefully and print it off or download it before placing your order. We may change these terms from time to time. Please check them before you make any new purchase

General
1. The Company will only accept orders based on their 'Terms & Conditions'.
2. These Terms & Conditions do not affect your statutory rights.
3. The Company and/or its agents will treat each order as an offer by you to purchase the goods subject to these Terms & Conditions. The Company's prices represent an 'Invitation to Treat' and can be amended or withdrawn at any time.
4. The right to refuse the supply of any goods will be at The Company's discretion.

Ordering
5. The 'confirmation' stage sets out the final details of your order. Following this, we will send to you an order acknowledgement email detailing the products you have ordered. Please note that this email is not an order confirmation or order acceptance from us.
6. Acceptance of your order and the completion of the contract between you and us will take place on dispatch to you of the products ordered unless we have notified you that we do not accept your order or you have cancelled it
7. The Company accepts orders on the basis that goods are subject to availability.

Price & Payment
8. The total price you pay for the goods will be stipulated at the point of payment. The Company is entitled to adjust the advertised price to take account of any increase in our supplier's prices, the imposition of any new
taxes or duties, typographical error, or error in pricing information from suppliers. Should The Company have cause to adjust the price you will be offered the opportunity to cancel the order before the dispatch of the goods. If we cannot contact you we will cancel the order and provide a full refund.
9. You can pay for your order by Visa, MasterCard, Delta/Connect or Switch/Maestro. We take payment from your card at the time we receive your order, once we have checked your card details and stock availability. Goods are subject to availability. In the event that we are unable to supply the goods, we will inform you of this as soon as possible (within 48 hours, but generally within 24 hours). A full refund will be given where you have already paid for the goods.
10. All prices and products quoted are subject to alteration or withdrawal without notice from time to time.

Ordering
11. We will acknowledge your order and confirm availability (or otherwise) by e-mail as soon as possible. Any e-mail or other electronic acknowledgement from us on receipt of your order does not constitute our legal acceptance of your order. Acceptance of your order, and the completion of the contract between you and us, will take place on despatch to you of the goods ordered (in whole or part).
12. By placing an order with us, you are accepting these Terms and Conditions, as well as our Privacy Policy and Terms of Website Use.

Stock Availability
13. If the goods ordered are unavailable, you will be contacted by e-mail or telephone and will have the option to wait until the stock is available, replace it with an alternative or cancel your order.
14. We will endeavor to deliver goods within the times stated but delivery dates are approximate and we shall not be liable for any losses, costs, damages, charges or expenses caused by any delay for delivery of the goods.

Delivery
15. Delivery is to mainland UK only (excluding Scottish highlands). The Company will endeavor to deliver goods within the times stated but goods are subject to availability and delay in delivery of goods is sometimes outside of our control. Any dates we specify for the delivery of the goods are approximate only and The Company shall not be liable for any losses, costs, damages, charges or expenses caused by any delay for the delivery of the goods.
16. Delivery of all items to LA postcodes (South Lakes and North Lancashire)is free of charge. Delivery to all other areas is £19.95 (for major appliances e.g. washers, fridges etc) and is free for small appliances (e.g. Vacuum cleaners, microwaves etc.) There is no further charge for additional items. If multiple items are ordered the higher charge shall apply.
17. We require you to sign a delivery note on receipt of the goods.
18. All of our deliveries are direct from either our own premises or direct from the manufacturer / supplier.
19. Deliveries are booked on the condition that there is reasonable access for the safe and prompt delivery of the product. Deliveries are to ground floor premises by one person only. Any special requirements should be notified to us at the point of ordering. For local LA postcode delivery we can use a two man delivery at no extra cost, provided we are notified at the
time of ordering.
20. One of our sales team or carrier will contact you within 48 hours of placing your order with an approx delivery date.
21. The delivery service does not include installation of the product orremoval of the old appliance
22. We reserve the right to charge £40 for re-delivery if you are not present at the agreed original delivery date.
23. Please ensure that you thoroughly inspect your goods for any Cosmetic damage, incorrect goods, missing parts or other problems as soon as you receive them, if this is done after delivery has taken place then please see the time limitations below.

Time Limit for Notification of Damage
24. If your goods arrive in a damaged condition, you must inform The Company in writing within 48 hours of delivery. Notification can be posted to Clocktower Electrics, Low Wood, Haverthwaite, Ulverston, Cumbria, LA12 8LY or faxed to our dedicated fax line 015395 30501. Alternately you can e-mail the Customer Services Department on customerservices@clocktowerelectrics.co.uk The Customer Services Department will arrange collection of these goods and will replace the goods at no charge or refund any monies paid for the goods. If no fault or damage is found on the goods then you will be charged the ACTUAL COST of collecting the item because we subsidise our delivery cost when we initially deliver the item to you
25. IF YOU DO NOT TAKE THE ACTION REQUIRED IN CLAUSE 23 THEN THE COMPANY SHALL ACCEPT NO LIABILITY FOR GOODS SAID TO BE DAMAGED ON DELIVERY.

Cancellation
26. In compliance with the distance selling regulations you have a Cooling Off period where you may withdraw from this agreement at any time up to 7 working days after the day we have delivered the goods to you. This must be done in a durable form, via e-mail, fax or letter to our contact details. If we have delivered the goods, you must not have used them and must have kept them in the condition they were delivered. You must return them to us or request us to collect them, in either case, at your cost. 27. Under the same regulations you have a duty to take reasonable care of the products. If you cancel an order after the goods have been delivered, you will be charged the ACTUAL COST of collecting the item because we
subsidise our delivery cost when we initially deliver the item to you. When we receive the goods we will inspect them to ensure all manuals, accessories and other components are within the returned package and that the goods are in the condition that we sent them to you with packaging. All items are subject to inspection. If we receive an item that you have not taken reasonable care of, we shall charge you a fee equivalent to the reduction in the item’s value. If the item has missing components, we shall charge you a further fee to cover the cost of these items. These costs will be deducted from any refund that is due to you.
28. Where you cancel your order under the Distance Selling Regulations, we will refund your money within 30 days of the day you cancelled your order.

Product Guarantees
29. All products are covered by a 12- month minimum manufacturer guarantee against faulty workmanship and materials, subject to manufacturer conditions. The details of the guarantee will be delivered with your product. 
30. The guarantee will not apply if the fault arises from fair wear and tear in our reasonable opinion, deliberate damage, accidental damage, negligence, abnormal working conditions, failure to follow manufacturer instructions,
misuse or alteration or repair of the goods without manufacturer approval.
31. The guarantee is for domestic use only (excluding specifically marked commercial appliances). Non-domestic use invalidates any guarantee.
32. If you suspect your goods to be faulty please contact us and we will arrange for trained engineer to visit. This is covered free of charge under the warranty, however If the engineer cannot find a fault with the product you may incur a call out charge.

Refunds
33. All requests for refunds must be made in writing. Requests can be made by email to customerservices@clocktowerelectrics.co.uk or in writing to Clocktower Electrics, Low Wood, Haverthwaite, Ulverston, Cumbria, LA12 8LY.
34. All refunds due for whatever reason (other than cancellations under the Distance Selling Regulations) will be made within 14 days of collection of the product.
35. Any deductions applicable, such as collection charges where applicable, will be deducted from the refund due.

Liability
36. The Laws of England and Wales shall govern the contract between The Company and any dispute will be resolved exclusively in the courts of England and Wales.
